California Consumer Privacy Act of 2018 (CCPA)

This Privacy Notice for California Residents states the privacy policies of 7 Leaves Cafe and all affiliates, subsidiaries, franchisees, and other entities lawfully doing business as or under the name 7 Leaves Cafe (collectively, “we,” “us,” or “our”) and applies to visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and California privacy laws. Any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). Personal information does not include publicly available information, deidentified or aggregate consumer information, or information excluded from the scope of the CCPA/CPRA.

In the preceding twelve (12) months, we have collected the following categories of personal information about California residents. Consumers may also request information about our collection practices extending back to January 1, 2022, to the extent we retain such information.

Sensitive Personal Information

In the preceding twelve (12) months, we have collected the following categories of Sensitive Personal Information (“SPI”):

Note on date of birth: We collect date of birth solely for loyalty program birthday rewards. Date of birth is personal information but is not Sensitive Personal Information under the CCPA/CPRA definition. It is disclosed here only for transparency regarding the loyalty program.

Under the CCPA/CPRA and the 2026 CPPA regulations, personal information collected from a consumer we know is under 16 years of age is treated as Sensitive Personal Information. We do not currently have a mechanism to verify consumer age at loyalty enrollment or mobile application download, and we do not knowingly collect personal information from consumers under 16 years of age. If we become aware that we have collected personal information from a consumer under 16, we will delete it promptly.

We use Sensitive Personal Information solely for the purposes disclosed above, which are limited to what is necessary to perform the services you have requested, to comply with law, or as otherwise permitted by CCPA/CPRA § 1798.121(a). We do not use or disclose Sensitive Personal Information for the purpose of inferring characteristics about you.

Right to Limit Use of Sensitive Personal Information. You have the right to direct us to limit our use of your Sensitive Personal Information to that which is necessary to perform the services or provide the goods reasonably expected. See “Your Rights and Choices” below for how to exercise this right.

If we disclose your personal information for a business purpose, the recipient of that information will sign a non-disclosure agreement that describes the purpose for disclosure and requires the recipient to both keep that personal information confidential and not use it for any purpose except for the purpose of performing the contract.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

Deletion Request Rights

You have the right to request that we delete any of your personal information that we have collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Exercising Access, Data Portability, and Deletion Rights

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or your authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and the extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
